1. Acceptance of Terms

Welcome to Babgverse (“the App”). By accessing or using the App, you (“User”) agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must not use the App.

2. Description of the Service

The App integrates with users’ Instagram Business accounts to retrieve, process, and respond to Instagram comments using GPT-based artificial intelligence.

The App does not permanently store user data or Instagram comment data on its own servers. Instead, it temporarily processes the information to generate AI-driven responses or insights.

Any output generated is provided for informational or facilitation purposes only, and you are responsible for how you use or rely on these outputs.

3. Eligibility

You must have the legal authority to enter into these Terms and comply with all applicable laws, rules, and regulations. By using the App, you represent and warrant that you are at least the age of majority in your jurisdiction.

4. User Responsibilities

You must provide accurate, current, and complete information when required.

You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

You agree not to use the App for any illegal, harmful, or unauthorized purpose, including but not limited to:

Violating any local, state, national, or international laws.

Infringing upon the rights of third parties, including intellectual property rights.

Transmitting any content that is unlawful, defamatory, harassing, or otherwise objectionable.

5. Intellectual Property

All trademarks, service marks, and logos displayed in the App are the property of their respective owners.

You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, or sell any information, software, products, or services obtained through the App unless specifically allowed.

6. Third-Party Services and Content

The App uses third-party services (e.g., OpenAI GPT) to generate responses to Instagram comments. We are not responsible for the content, quality, or accuracy of the outputs provided by these third-party services.

The App is not endorsed, affiliated, or sponsored by Instagram or Facebook (“Meta”) or OpenAI, and it is your responsibility to comply with any third-party terms and policies.

7. Disclaimers

No Storage of Comment Data: The App processes comments in real time but does not store them permanently. By using the App, you acknowledge that certain data may briefly be transmitted to our service and to GPT in order to generate responses, but the App does not keep or archive comment data.

As-Is, As-Available: The App is provided on an “as is” and “as available” basis. We do not guarantee that the App will be error-free, uninterrupted, secure, or produce specific results.

No Warranties: To the fullest extent permitted by law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of Liability

Under no circumstances shall Babgverse, its affiliates, employees, or agents be liable for any indirect, incidental, special, consequential, or exemplary damages resulting from your use or inability to use the App. Your sole remedy for dissatisfaction with the App is to stop using it.

9. Indemnification

You agree to defend, indemnify, and hold harmless Babgverse, its affiliates, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We reserve the right, in our sole discretion, to suspend or terminate your access to the App at any time, without notice, for any reason, including a breach of these Terms.

11. Changes to These Terms

We may update these Terms from time to time. The most current version will be posted on our website. Your continued use of the App after any modifications constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of United States. Any disputes arising out of or related to these Terms will be subject to the exclusive jurisdiction of the courts located in United States.
